General Terms and Conditions for Accommodation
1. Scope of application
These General Terms and Conditions apply to all contracts concerning the provision of guest rooms and other accommodation services between Villa Burgau by RoBi GmbH, Herbert-Isaac-Straße 16, 52156 Monschau – hereinafter referred to as the “Accommodation Provider” – and the guest.
They apply to all services provided by the Accommodation Provider, in particular the provision of guest rooms and optional additional services such as breakfast.
Deviating agreements are possible if expressly confirmed by the Accommodation Provider.
2. Booking enquiry and conclusion of contract
Guests may submit a non-binding enquiry regarding a stay via the enquiry form on the website or by telephone.
Submitting a booking enquiry does not constitute a binding booking or the conclusion of a contract.
After receiving the enquiry, the Accommodation Provider checks availability and informs the guest of the available services and price.
An accommodation contract only comes into effect once the Accommodation Provider has expressly confirmed the booking. Confirmation may be given by telephone or email. Once the accommodation contract has been concluded, the agreed services and period are binding.
The scope of the booked services is determined by the information in the booking confirmation.
3. Services and prices
The Accommodation Provider undertakes to provide the guest with the booked room for the agreed period.
The applicable prices are set out in the individual offer or booking confirmation.
Breakfast is not automatically included in the overnight accommodation price. It may be added for an additional charge.
Any additional fees or charges for specific services will be communicated to the guest before or, at the latest, with the booking confirmation.
4. Arrival and departure
Regular check-in is available from 2:00 p.m. to 5:00 p.m.
Check-out must take place by 10:00 a.m.
Earlier or later check-in may be possible by prior arrangement.
The Accommodation Provider may use a key box for arrival. The necessary access information will be provided to the guest in good time.
The guest is responsible for keeping the access information confidential and not passing it on to unauthorised third parties.
5. Payment terms
Payment is made in accordance with the terms agreed in the booking confirmation.
Payment is generally possible by cash or bank transfer.
In the case of payment by bank transfer, the invoice or payment amount must be paid within the period specified in the booking confirmation.
If payment is not made on time, the Accommodation Provider may cancel the booking after granting a reasonable additional period, unless otherwise agreed.
6. Cancellation by the guest
The guest may cancel the booking free of charge up to one day before the agreed arrival date, unless different conditions have been agreed in the booking confirmation.
In the event of a later cancellation or no-show, cancellation or non-arrival costs may apply.
Unless otherwise agreed individually, the Accommodation Provider may generally claim the actual damage incurred or the value of services that could not be rented to someone else due to the short-notice cancellation or no-show. Saved expenses and alternative rentals will be taken into account.
The guest remains entitled to prove that no damage or considerably less damage was incurred.
7. Cancellation by the Accommodation Provider
The Accommodation Provider may withdraw from the contract or cancel the booking for good cause. Good cause exists in particular if performance becomes impossible due to force majeure or other circumstances for which the Accommodation Provider is not responsible.
8. Use of the rooms
The rooms may only be used by the number of persons stated in the booking.
The room may only be made available to third parties with the prior consent of the Accommodation Provider.
The guest undertakes to treat the room and the Accommodation Provider’s facilities with care and to show consideration for other guests and the surrounding area.
Damage or unusual incidents must be reported to the Accommodation Provider immediately.
The guest is liable for damage culpably caused by the guest or by persons accompanying or visiting the guest.
9. Accessibility
Due to the structural conditions of the property, our accommodation is not wheelchair accessible and is not suitable for guests with limited mobility. In particular, the building has structural features that may make use of the accommodation difficult or impossible for persons with mobility impairments. No facilities designed for guests with disabilities are available.
Guests with specific mobility or support needs are asked to contact us before booking so that the conditions of the accommodation can be discussed on an individual basis.
10. Smoking and pets
Smoking is not permitted anywhere in the building.
Pets are not permitted at Villa Burgau.
In the event of a breach of the smoking ban or the rules regarding pets, further statutory claims remain unaffected, in particular claims for compensation for actual damage or necessary additional cleaning costs.
11. Liability
The Accommodation Provider is liable for damage suffered by the guest in accordance with statutory provisions.
Statutory provisions concerning the liability of accommodation providers apply to items brought onto the premises.
The guest is obliged to treat the accommodation and its furnishings with care.
The guest is liable under statutory provisions for damage culpably caused by the guest, fellow travellers or persons brought or invited by the guest.
This applies in particular to damage to rooms, furniture, fixtures and other equipment.
In the case of unusually heavy soiling exceeding the usual cleaning required after a stay, and culpably caused by the guest, the actual and reasonable additional cleaning costs may be charged.
No flat-rate damage charge will be imposed insofar as this would restrict the guest’s statutory rights.
12. Data protection
Personal data is processed in accordance with the Privacy Policy published on the website and the applicable data protection regulations.
13. Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
The guest’s statutory rights remain unaffected, in particular the right to obtain information from a competent consumer arbitration board or to contact a competent authority in the event of a dispute. Where legally required, the relevant information will be provided in text form on a case-by-case basis.
14. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as legally permissible.
The statutory jurisdiction provisions apply to consumers.
Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the applicable statutory provision.
